Deputy lands director charged with Sh1.35billion land fraud

The Assistant Deputy Director in the Lands Administration Office has been arraigned in Court facing charges of conspiring to defraud a parcel of land located at lower Kabete valued at Ksh 1.35 billion.

Andrew Aseri Kirungu was arraigned in a Nairobi Court on Friday afternoon where the prosecution alleged that he and Davis Nathan Chelogoi conspired to defraud Mr. Ashok Rupshi and Hitenkumar Amritlal Raja of the said land measuring 7.39 Hectares situated along Lowe Kabete Road valued at Ksh 1,350,000,000.

Andrew was further charged with fraudulently obtaining a Land registration number.

The prosecution alleged that on diverse dates between May 2020 and June 2021, Andrew and Chelogoi while at the State Department of Lands and Physical Planning in Nairobi, with intent to defraud, procured registration of the said land by falsely pretending the land belonged to Davis Nathan Chelogoi.

He was further charged with abuse of office contrary to section 101 of the Penal Code.

According to the Prosecution, Andrew Aseri on diverse dates between December 2020 and May 2021 at the State Department of Lands and Physical Planning in Nairobi, being a person employed in the Public service as an Assistant Deputy Director in the Lands Administration Officer, for the purpose of gain, fraudulently made certificate of Title L.R No. 18485I.R. No. 232908 in abuse of the authority of his office which was prejudicial to the alleged legal owners of the said land.

However, the other accused person Davis Nathan Chelogoi remains at large with the investigation officer informing the Court that they believe he might have run to Uganda to evade Justice.

Andrew Aseri Kirungu appearing before PM. Dolphina Alego at Milimani Law Courts denied the charges and will be remanded in Custody until December 28, 2023, when the Court will issue a ruling on whether to release him on bond and or bail pending the hearing and determination of the case.
