Two Police Officers Charged with Torture and Abuse of Office Over Unlawful Detention

by Irene Onyango

Two police officers formerly stationed at Eastleigh North Police Station are facing charges of torture and abuse of office in connection with the unlawful arrest and detention of a woman in 2021.

Rebecca Njeri Muraya and Sgt. Abdisalam Ahmed appeared before Milimani Chief Magistrate Lukas Onyina, where they denied the charges brought against them.

The duo is accused of illegally detaining Ayni Hussein Mahammud on December 31, 2021, in an alleged attempt to intimidate her from pursuing a complaint of assault she had lodged against one Abdihakim Saidi Jama.

According to the charge sheet, the officers arrested Mahammud without sufficient cause and held her at Muthaiga Police Station for two days, in what is believed to have been an effort to frustrate her access to justice.

Muraya and Ahmed are facing charges of torture, contrary to Section 4(a)(iii) as read with Section 5(1) of the Prevention of Torture Act, and abuse of office, contrary to Section 101(1) as read with Section 102 of the Penal Code.

The court released the two on a bond of Sh 500,000 each.
